Are you dealing with a hate crime or a bias incident?

Hate crimes are a matter for the criminal justice system; bias incidents are governed by campus policy.

Penn State University Policies AD 29 and AD 91

AD29 - STATEMENT ON INTOLERANCE
"An act of intolerance refers to conduct that is in violation of a University policy, rule or regulation and is motivated by discriminatory bias against or hatred toward other individuals or groups based on characteristics such as age, ancestry, color, disability or handicap, national origin, political belief, race, religious creed, sex, sexual orientation, gender identity or veteran status."

Policy AD91 - DISCRIMINATION AND HARASSMENT, AND RELATED INAPPROPRIATE CONDUCT
"It is the policy of the University to maintain an environment free of harassment and free of discrimination against any person because of age, race, color, ancestry, national origin, religion, creed, service in the uniformed services (as defined in state and federal law), veteran status, sex, sexual orientation, marital or family status, pregnancy, pregnancy-related conditions, physical or mental disability, gender, perceived gender, gender identity, genetic information or political ideas. Discriminatory conduct and harassment, as well as sexual misconduct and relationship violence, violates the dignity of individuals, impedes the realization of the University’s educational mission, and will not be tolerated."

Harassment

Harassment is a form of discrimination consisting of physical or verbal conduct that:

1. Is directed at an individual because of the individual's age, ancestry, color, disability, or handicap, national origin, race, religious creed, sex, sexual orientation, gender identity or veteran status.

2. Is sufficiently severe or pervasive so as to substantially interfere with the individual's employment, education, or access to University programs, activities and opportunities. To constitute prohibited harassment, the conduct must be such that it detrimentally affects the individual in question and would also detrimentally affect a reasonable person under the same circumstances.'

Bias Related Incident

A 'bias-related incident' is any incident in which an action taken by a person or group is perceived to be malicious or discriminatory toward another person or group based on bias or prejudice relation to such characteristics as race, color, religion, national origin, ancestry, age, mental or physical disability, sexual orientation, gender, or gender identity or any situation in which inter group tensions exist based on such group characteristics. Bias-related incidents may be violations of criminal law, such as "Hate Crimes," or violations of civil law, such as unlawful e discrimination in employment, housing, education or public accommodations. In Pennsylvania, the legal definition of a hate crime is determined by Pennsylvania's "Hate Crime" Law, the Ethnic Intimidation and Institutional Vandalism Act.
